End User License Agreement This License Agreement (this "Agreement") is a legal agreement between you and Pacific Tech for the accompanying software and documentation (collectively, the "Product"). By purchasing the Product, you agree to be bound by the terms of this Agreement. If you do not agree to all of the terms of this agreement, do not purchase the software. For individual copies, Pacific Tech grants a non-exclusive license to use the Product for your own use only. For multiple-copy licenses, Pacific Tech grants a non-exclusive license to use the Product on the specified number of machines. The first time you run the Product you will be prompted to enter the Name and Serial Number as they appear on your receipt. This information will then be transmitted to back to Pacific Tech to request a hardware Registration Key to enable the software for that computer. Individual User Licenses entitle you to install, register, and use the Product on both your home and work computers. Student Licenses are available at a student discount, but entitle you to register and use the Product on only one computer. Multiple-copy licenses can be registered on the specified number of computers. For individual customers, you must not allow copies of the Product or any part of it to be distributed to anyone else. For multiple-copy licenses, you must ensure that the software is installed on only the specified number of machines. The Product is delivered only digitally. There are no physical media or printed manuals. You are encouraged to make backup copies for archival purposes. Pacific Tech retains all ownership and intellectual property rights in and to the Product. You agree to abide by the copyright law and all other applicable laws of the United States. You may not remove or alter any of Pacific Tech's copyright notices from any components of Product. You may not sublicense, rent or lease all or part ofthe Product. The Product is copyrighted with all rights reserved. None of the components of the Product may be copied, removed or altered, in whole or part, for any unauthorized use. The Product in source code form is confidential and Pacific Tech's protected trade secret, and you may not attempt to reverse engineer, decompile, disassemble or otherwise decipher any portion of the Product. Pacific Tech disclaims all other warranties, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the product. This limited warranty gives you specific legal rights. You may have others, which vary from state to state. No Pacific Tech distributor, dealer, agent, or employee is authorized to make any modification, extension, or addition to this limited warranty. In no event will Pacific Tech, its licensees, distributors or dealers be liable for direct, incidental or consequential damages, including but not limited to damages resulting from loss of data or business opportunities, resulting from the Product, either alone or in conjunction with other programs. This Agreement constitutes the entire Agreement between you and Pacific Tech. It is governed by the laws of the State of California. Restricted Rights Legend Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause in DFAR 52.227-7013 or the equivalent clause in FAR 52.227-14, whichever is applicable.
